1. Purpose of the privacy policy.

Maison Nanou official is committed to the right to privacy and makes every effort to ensure that all personal data is obtained, processed and used in a safe, reliable, ethical and transparent manner. Your privacy is important to us. We appreciate that you trust that we will use your personal data both carefully and sensibly, in accordance with the principles of this privacy policy, which is in effect when you use our services (these are all activities related to our web shops and physical stores, including the sale and rental of our products).

This privacy policy aims to make it clear to you what personal data we collect about you, why we collect it and what we do with it. References to personal data in this privacy policy include any information that directly or indirectly identifies you, such as your first name, name, online identifiers, email address, billing and delivery address or previous purchases.

Note that this policy applies in conjunction with other policies and procedures. It does not establish contractual or legal rights for anyone, but it is intended to ensure compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to processing of personal data and on the free movement of such data (hereinafter referred to as the 'General Data Protection Regulation' or 'GDPR').

3. How we collect and process your personal data. 

 

3.1. Personal data we collect about you.

Because we believe data privacy is so important, we want to remain open and transparent about how we use your personal data.

Maison Nanou official will only collect your personal data when necessary in the context of our services.

Depending on your use of our services and our websites, we may therefore collect, use and disclose (i.e. process) the following types of personal data about you: your contact details, such as your first name, surname, e-mail address, IP address and telephone number. Even though we are technically regarded as 'data controllers', the ultimate control over your personal data remains in your hands. If you provide us with proof of your real identity, you have the right to request access to a copy of the personal data we currently hold about you in a structured, commonly used and machine-readable format and to obtain information about the processing, including about whether we process your personal data for profiling purposes. If you notice an error in your personal data, you can also ask us to correct the incorrect personal data or to complete your personal data. We will then notify all third parties to whom we have disclosed your personal data, so that they can ensure that your personal data is completely accurate with them. When technically feasible, you have the right to request that Maison Nanou forward your personal data to another company of your choice.

 

3.2. Legal grounds for the processing.

Under applicable data protection law, personal data may only be collected and processed on the basis of a limited number of legal grounds.

At Maison Nanou, we rely on one of the following legal grounds to process your personal data:

  1. Need for the performance of a contract with you (e.g. when you buy products from us);

  2. Legal obligation to which Maison Nanou is subject (e.g. when we handle your payment information);

  3. Legitimate interests of Maison Nanou (e.g. when we send you marketing emails about products that are similar to the ones you have already purchased from us);

  4. Your explicit and informed consent (e.g. when you register for our newsletters through your marketing preferences or when you enter a competition).

 

3.3. Buying products through our website.

If you purchase products from our web shops, Maison Nanou will request your personal data to manage your payments, process your orders and ensure that the products you have purchased are delivered to the correct address by our external parcel deliverers.

When you want to purchase products through our websites, Maison Nanou will collect personal data such as your first name, surname, email address, telephone number, billing and delivery details and limited information about your payment card. We process your personal data for the purposes set out above as this is necessary for the performance of our contract with you.

We may also need to process other personal data, such as your navigation and surfing behavior. For example, our intention is to store items in your shopping cart or to provide you with relevant product recommendations or tailor-made suggestions. In addition, the processing of this personal data allows us to keep a record of your purchase history, for example if you change your mind after your purchase or if you need to return a product in accordance with the applicable return policy.

3.4. Marketing emails and newsletters.

Some of our customers really enjoy receiving newsletters about our latest products and services. However, we understand that this is not the case for everyone. Therefore, the processing of your personal data for marketing purposes is based solely on your explicit prior consent. This means that we will never send you marketing communications if you do not appreciate it, unless you have already purchased products from us. If you would like newsletters about our latest products and services, you can subscribe to our newsletters by email via our website. In that case we will process your e-mail address.

Once you are enrolled, you can object at any time to the use of your personal data for profiling by Maison Nanou or by any of the third party recipients with whom we have shared your personal data, provided that we process your personal data on the basis of our legitimate interests. If we process your personal data for direct marketing purposes, for example to send you newsletters, you have the right to object at any time to the use of your personal data for that purpose by contacting our head office. You can find our contact details at the bottom. This does not entail any additional costs.

 

3.5. Information we collect in our stores.

When you purchase products from our stores, we may process personal data such as your name, contact details and limited payment details, as this information is necessary for the performance of the contract with you.

If you already have an account, we may use information about your previous online and in-store purchases. After all, this information helps us make purchases easier, process payments, manage returns, and also benefits marketing purposes. We process personal data for these purposes because it is in our legitimate interest to gain insights about our customers who buy our products, both in the stores and in the web shops.

Since we process your personal data on the basis of our legitimate interests, you can object at any time to the use of your personal data for profiling by Maison Nanou or by any of the receiving third parties with whom we have shared your personal data. 3.6. Events and competition forms.

Maison Nanou regularly organizes competitions for our customers. As we need to identify the entrants and contact the winners, we will need your contact details and your age (to verify that you are legally allowed to participate) as well as any other additional information you may wish to provide to us. The processing of your personal data is based on your explicit and informed consent. In addition, your personal data may be shared with third parties so that they can provide prices and track delivery.

In addition, Maison Nanou also organizes events in collaboration with third parties. When you register for those events, we process your contact details for invitations and attendance lists, based on the performance of a contractual relationship. Maison Nanou will under no circumstances sell your personal data to the third parties we work with.

The GDPR grants you the right to object at any time to the use of your personal data by Maison Nanou or by any of the receiving third parties with whom we have shared your personal data for this purpose. This means that we will no longer be able to process your personal data, but we can still keep your personal data until you explicitly ask us to delete it.

We have a legitimate interest in ensuring that technical support is provided promptly and effectively and that complaints and requests regarding product warranties are dealt with promptly and effectively. To this end, we may process data such as your name, contact details, date of birth, gender, bank account number (e.g. for refunds), purchase history and browsing activities. When you have contacted our customer support through social media, we may also process certain information about your social media account.

You have the right to request Maison Nanou access to a copy of the personal data we currently hold about you in a structured, commonly used and machine-readable format and to obtain information about the processing, including whether we are processing your personal data for profiling purposes. 4. How we protect your personal data.

Maison Nanou makes every effort to ensure legal, fair and transparent processing of your personal data. Accordingly, we will only use your personal data if we have a valid reason for doing so and provided you have been informed in advance of the processing purposes, in particular at the time we collected your personal data.

In addition, Maison Nanou guarantees that any processing of your personal data is limited to what is necessary, suitable and relevant to achieve the purposes for which the personal data were collected. Whenever possible and technically feasible, Maison Nanou will use anonymised or pseudonymized data, e.g. for purposes related to our internal statistics and financial reporting.

Because we consider the protection of your personal data of the utmost importance, Maison Nanou also pays a lot of attention to the protection of your personal data and the systems in which they are stored. We have established and implemented appropriate technical and organizational measures against unauthorized access, illegal use, accidental loss, damage or destruction. Maison Nanou is confident that your personal data will be processed on a strict 'need to know' basis, where and when appropriate and necessary.

In addition, these receiving third parties must destroy or return all personal data to Maison Nanou after the end of the service related to the processing and must destroy existing copies unless it is required by law to keep the personal data.

 

6. International transfers of your personal data.

To the extent that your personal data needs to be transferred from the European Economic Area to a country outside the EEA that does not provide adequate data protection, appropriate measures will be taken to protect personal data in accordance with standards equivalent to those of this privacy policy. In other words, Maison Nanou remains liable for the processing of your personal data and will take the necessary measures to protect the processing thereof by relying on, for example, the EU-US Privacy Shield.

7. How long do we keep your personal data.

As a general rule, Maison Nanou only keeps your personal data for as long as it is necessary to fulfill the purpose for which we originally collected it. However, those needs may vary for different data types in the context of different products. Therefore, actual retention periods can vary significantly. In addition, laws and regulations apply that also set minimum retention periods for personal data.

Maison Nanou will always ensure that you are informed of the criteria used to determine the actual retention period and the underlying reasons for it. These depend on whether we process your personal data in the context of a contractual relationship with you or on the basis of your explicit consent, whether we process the personal data for your own legitimate interest, and whether Maison Nanou is legally obliged to keep the personal data for keep a period of time in order to comply with specific legal obligations.

8. How we delete your personal data.

In certain circumstances, and provided you provide us with proof of your real identity, you can exercise your right to request that your personal data be erased and that we notify third parties to whom we have provided your personal data of this. request. Please note that this is only possible to the extent that the personal data is no longer necessary for the original purpose (i), if the processing was based on your consent and you withdraw it (ii) or if you already object objected to processing based on our legitimate interest (iii).

Except where we need to keep a copy of your personal data for statistical purposes, to establish, exercise or defend legal claims (e.g. in connection with the warranty period applicable to products sold by Maison Nanou) or for to the extent that we are required by law to keep a copy of your personal data, you can rest assured that Maison Nanou will either securely delete your personal data or anonymize it permanently once we have fulfilled the original processing purpose and when it is no longer necessary to delete your personal data to keep up.

9. Your rights as a data subject.

If you would like more information or wish to exercise any of your above rights, please contact us at hello@maison-nanou.com We will do our best to answer your email as soon as possible, and in any case within one month. If it takes more time for us to comply with your request, we will notify you and contact you again within two additional months. Maison Nanou will not charge you for this unless we have previously provided you with the requested information or unless it is unreasonably difficult for us to obtain that information. In that case, we will let you know the administrative costs in advance.

If you are not satisfied with the way we have handled your request, you have the right to request that our use of your personal data be restricted and to lodge a complaint with the supervisory authority responsible for the protection of personal data in your country of residence. Although we sincerely hope that this will not be necessary, we have provided the contact details of the relevant data protection authorities below.
